Cyier platform appreciates that you trust in our services and provide your personal data through Cyier platform, so we confirm our respect for your right to keep your personal data private, so we have drafted a privacy policy according to the applicable laws in line with the work nature of our platform for the purpose of managing your data collection and usage.

Awalem Cyier Company in the Kingdom of Saudi Arabia manages the data you provide and the data we collect through Cyier platform through Cyier platform team. We collect the data for the purposes shown in this policy.

- The privacy policy and the terms and conditions form the terms of use of Cyier platform, and your use of Cyier platform or providing any data to us is explicit approval by you of the privacy policy and the terms and conditions.

Section 1: Definitions

In order to interpret the terminology contained in this policy, all definitions contained in the terms and conditions document are an integral part of the privacy policy, complement and interpret its clauses and terminology. In addition, the following terminology shall have the meanings referred to next to each terminology:

“Policy” or “Privacy Policy” refers to this document as well as the terms and conditions contained herein.

“Data” refers to all data provided to us by the User/Host or that we collect about the User/Host or that relates to the User/Host's activity or transactions he\she make through Cyier platform or any data is being collected or processed in any way.

Section 2: Data we collect about you

Through Cyier platform, we collect and process some of your data which we can get in different ways, such as the data we get through Cyier platform forms, the data you provided to us by yourself, the data that we ask you to in order to deliver the services, or the data that is automatically collected. The following are the data categories we collect about you:

(1) Account Data

1. When registering on the platform with a User account, you provide us with the following data, primarily (Name, password), and we offer you registration through other options (Mobile number, Google account, Facebook account, Apple account).

2. The Host provides us with the signup information by filling out the online form prepared for this, and this information includes (Name, Email, Photo/Company logo, License, Qualifications).

3. The User/Host provides us with any updates related to his\her data. By accessing his\her profile, he\she can edit the data he\she provided us at any time.

4. We require from you to create your account in the platform for allocating your experience while using the services and enabling the Host to provide the service as well as enabling the User to benefit from them in addition to securing the electronic payment process.

5. When the User/Host creates an account in the application, he:

·     Acknowledge that the information is true, legal and connected with him as well as the correspondence to the data required via the application.

·     Undertakes to maintain the accuracy of the information and data he provided via the platform or through the contract.

6. You acknowledge that your use of the services shall not violate any law or regulations in force or any of the conditions herein. You acknowledge that you shall be liable for the user name and password of your account as well as for the disclosure of data done via this account.

(2) Services Data

1. The platform collects the content that you provide through it, including the service content, images, information, data, comments, posts, and all activities that you do through the platform.

2. Your service order is registered through the platform and the service orders are registered with serial or non-serial numbers. The order includes the service type and details, price, tax, payment method and client contact details.

(3) Payment Data

1. During registration on the platform, the Host provides us with his\her bank account number, for the purposes of payment through the platform and receiving profits after processing and final settlement of orders through the platform. We also use an electronic payment gateway through the platform that is provided by an electronic payment service provider contracting with the platform, and the payment data that the user enters through the payment gateway is encrypted to ensure that the banking data is secured.

2. We allow the user an e-wallet through the platform, in which amounts are deposited, as well as profits are received. The wallet is for in-platform use only. The platform, from time to time, transfers profits to the bank accounts of the Host.

(4) Communication on the platform

1. The platform provides User/Host with a chat service within the platform, which allows the User to communicate with the Host via chat to discuss on services and their details.

2. Messages appear to a closed group of users who are the sender and the receiver, are not used for statistical purposes.

3. The platform does not monitor or track messages sent between the parties via the platform, and we check the chats upon the request of one of the parties in the event of a dispute between the parties of the chat, and the platform sees the chat for the purposes of settling the dispute through the platform, and the platform does not disclose the data of the chats to other parties.

(5) Location

1. The Host adds the location of the trip on the maps, and the Host allows the location to appear on the maps and the User's access to the location for the purposes of performance the service.

2. The Host knows that the maps will be visible to the users and visitors of the platform, and this location can also be used to promote the platform or the services offered through it.

(6) Reviews

Adding the review through the platform requires login to your account, and we will collect the review data that you added through the platform, which includes the account name and the comment that is added.

(7) Other Data

We may collect and process certain other data, including:

1. Data you provide us with when you report a problem in Cyier platform.

2. The data you provide us with upon the occurrence of a problem related to the process of payment of the amounts you must pay.

3. Data you provide us with when you communicate with us or the customer service for any reason.

4. Data you provide us with when you evaluate the services you received via Cyier platform.

5. The data we see to be necessary for ascertaining your identity or ascertaining the validity and legality of any operations you carry out via the site including a photo copy of your passport or ID card.

(8) Data we collect automatically

Data we collect automatically about the use of our services. We might receive some information from the internet browser and your personal computer including the cookies and this includes (referral links, your IP addresses, device type and operating system, inaccurate location collected by your ISP).

(9) Permissions

The platform requires some permissions from the user in order to be able to deliver our services, so it requires taking advantage of the permission services to access (camera, precise location, notifications, photo gallery).

Section 3: The competence required to provide the data

1. When you use or provide data through Cyier platform, you acknowledge that you are legally competent to provide data to us, that you are 18 or more, if you are less than that, you must use Cyier platform and provide your data through your guardian.

2. Cyier platform cannot check the age of each user or each one who provides his\her data to us, so you provide the data at your own risk.

Section 4: Data Collection Approval

You give us your approval to collect and use your data according to the privacy policy provisions, and you acknowledge that providing data to us or using Cyier platform is explicit approval by you to collect, process and use the data within the limits of this policy.

Section 5: Data Protection Laws

When using your data, we consider all the laws applicable in the Kingdom of Saudi Arabia that protect data and set limits on its use and management, including the data protection law and e-commerce regulation and its executive regulations.

Section 6: Cookies

Correlation definition files “Cookies” are text small files stored on your device once you visit Cyier platform and they don’t appear in the form of a program and these files shall be used for the following purposes:

(1) Cookies are used for the purposes of providing services where they help us understand the using method by the visitors and users of Cyier platform. Cookies help us discover errors and repair them. Also, they help us develop Cyier platform and provide better content appropriate to the user as well as a better provision of the service. Cookies help us you find the data you need during your use of Cyier platform.

(2) We don’t have any authority over the correlation definition files related to other bodies and you undertake to have access to the privacy policies and the use of the cookies files related to these bodies. They help you through your device control the settings of cookies and control they in the way that is suitable for you.

(3) To enable you to offer services through the platform, add your location on maps, deliver services to users via the Internet, and enable other users to access your services in the location specified on the map.

(4) For enabling you to submit the services orders online via Cyier platform and paying for the services via the methods of electronic payment approved by us.

(5) To enable you to communicate with other users through the platform, by opening a chat and sharing information related to the services offered or requested through the chat.

(6) To enable you to use the e-wallet that we dedicate for use through the platform in order to add balance to, receive profits on, or receive payments for incomplete transactions.

(7) Receiving your comments and assessment of the service you received via Cyier platform as well as replying them. Receiving your questions, complaints and inquiries as well as replying them.

(8) Providing you with the information about services you order via Cyier platform. Providing you with the information about services we think you are interested in including our special offers. We use your data for providing you with what is new in relation to our services, modifying them or improving them including the online communication with you via the messages of e-mail or phone through contacting you at your phone number.

(9) We use your data for the purposes of providing our services, turning them on, updating them, measuring the level of services, improving them, for allocating the content, recommendations and advertisements we offer or offered by third parties to you whether in relation to the services or in any other place on the internet.

(11) We use your data for the purposes of implementing our terms and conditions as well as the payment of amounts you must pay. Also, we use your data for solving problems and preventing the illegal activities including the deception and hacking acts.

(12) We use your data for documenting the data with third parties such as services Hosts, Users and banks for the purpose of the safety of your transactions and documenting credit cards.

(13) We use the name, content, search log, user kinetic gestures, reviews, geographical location and financial operations log for statistical purposes, network information and cookies are used for operational purposes, and the mobility log is also used for navigation purposes.

Section 8: Sharing Content with Others

The user might share his information with others in many ways such as sharing the Cyier services such as persons and accounts with whom the user communicates and the general information that can be viewed by any person such as the name and any information shared by the user in general and the content shared by others or reshared in respect with the user or the information connected with the status of the user activity or his existence via our services such as identifying the last time the account has been used.

Section 9: Protection of the data

(1) Cyier platform may send personal information outside the country or region and Cyier platform will remain responsible for personal information that is transferred to a third party abroad to be processed or to support our efforts in providing our services to you. Any personal information that is transferred to a third party for data processing is subject under the law and regulations to a level of protection similar to that provided by Cyier platform. "Similar level of protection" means a level of protection generally equivalent to the level of protection provided by Cyier platform.

(2) Cyier platform undertakes to take the reasonable steps for ensuring that the personal data and the relevant records are safely protected in a proportionate way in relation to their importance. In case Cyier platform has been hacked or hacking, Cyier platform will not be responsible in any way whether in whole or in part for the use, copy or sell of your data or part of them. Cyier platform undertakes to notify you whenever our database is hacked within 72 hours after we know about the breach.

Section 10: Emails and Notifications

Your registration and use of Cyier platform shall be deemed to be an agreement on receiving e-mails promoting our services and notices of Cyier platform and its policy and in case you don’t wish to do so, you can suspend the reception of these messages through correspondence with us. In this case we don’t ensure that you will enjoy our services fully.

Section 11: Visible Data

(1) When you use our services or share some of your data with us, you know and agree that some data will be visible to other visitors and users of the platform, such as your name, profile picture, comments, your public posts, and any other data that is identified as public data.

(2) User profile: Any person registered on the platform or a visitor can view the profiles of other users, and the following information appears (user name, review, user profile "bio", content added by the user, posts, comments).

Section 12: Management of Your Personal Data

We allow users to access and review the registered data on the platform. The user has the right to contact us at any time to know the data we collected about him, he has the right to request editing or deleting these data, and it's required that this step should be done legally and not be intended to mislead.

Section 13: Disclosure of Your Data

(1) You shall entitle us to allow our employees to deal with your personal data within the limits of providing the services.

(2) We are authorized to make available the data you add yourself through the platform via the Internet, and you know that the data related to the services, account name and account image will be shared and will be visible to all users of the platform. Photos are shared with other users; the photos are not shared with third parties. Also, location is shared with other users.

(3) Some data is shared among users for the purposes of service implementation and for the purposes of the communication process between the parties, and therefore you agree that the Platform will share any data of your own with other parties on the Platform.

(4) We in Cyier platform provide an online payment service through an online payment service provider that processes all online payments made through Cyier platform he also may check any transaction to make sure that it is legal or ask for any additional evidence of any transaction.

(5) If we sell the platform, transfer management rights to another party or enter partners with us, we will transfer data from the current platform management to the new management of the platform.

(6) We may share your data collected or processed in accordance with this Policy with a third party including: (Name, profile" bio", Commercial Registry, Tax Number, Content, Reviews, Financial Operations Registry, Phone).

(7) The bank account is shared in-house for accounting and fund transfer purposes, is not shared with third parties. E-payment method data is shared with a third party (e-payment service provider), is not accessed by us, is not used for analytical purposes.

(8) We might reveal your personal data in compliance with legal or contractual obligations in the following cases:

1. In case we are required to disclose your personal data or to share it in compliance with any legal obligation or for the imposition or application of our terms and conditions or any other agreement.

2. In case of rendering a judicial decision or order by the various judicial competent bodies that bind on us.

3. In case of issuing a decision by the public authorities that bind on us.

Section 14: Obligations of Parties

(1) The user knows and agrees that the platform controls only the data collected by itself or providing by the user to us and we have no control over any data provided by the user to the Host/User. Thus, the user shall be bound not to disclose any unnecessary personal data to the Hosts/Users for the provision of services. Also, the user shall be liable for providing directly any data to the Hosts/Users without any legal or joint liability of the platform.

(2) The users shall be bound to keep all the data obtained from the Hosts/Users whether through us or the Hosts/Users themselves and the user acknowledges not to exploit this data in relation to any sale, communication, direct or indirect or any exploitation of data whatsoever without having the consent of the user who owns the data. In case of the breach by the user of these obligations, he shall incur all the liability, claims and compensations without our liability.

Section 15: Enforcement of Law

(1) For implementing nay legal requests, we might reveal the data registered in the registration form or provided to us by the user at any time as well as all the activities and transactions he has done via the application. This, shall be determined based on the request, decision or the judicial decision rendered to us.

(2) Cyier platform logs all basic information for users, including the dates of their joining to the application, actions taken against them regarding the deletion or blocking from the application, and the dates of that as well as recorded orders.

Section 16: Modifications

(1) We shall be entitled to modify our privacy policy at anytime and we shall publish a general notice of the new modifications via Cyier platform. Also, we shall update “Last Updated” at the top of this document.

(2) Your continuity of using Cyier platform after updating this policy shall be deemed to be an express consent by you to these modifications and a legal acceptance of the new practices and terms.

(3) In case you don’t agree on the new modifications and updates, you must immediately suspend the use of Cyier platform.

(4) You should have access to the privacy policy from time to another in relation to its terms and updates.
